Protect Citizens, Businesses and Organizations From an Out of Control Federal Government
Over 60% of citizens believe the federal government is out of control and is subjecting honest citizens to abuse of its powers on non-federal property using unnecessary SWAT style home invasions by federal police forces and agencies, unwarranted arrests, and seizure or destruction of private property. We support constitutionally sound statutes that will put checks in place to protect private individuals and companies from federal abuse without interfering with legitimate federal actions.
Most people are unaware of the fact that the county sheriff is the highest Law Enforcement Officer in the county; the Governor, the FBI, the EPA, and even the President ARE NOT! The legislation we support would make our county sheriffs responsible to use their authority to prevent such abuses of power and violation of our Constitutional Rights by federal agencies. How? The legislation will require the local Sheriff to stop any federal action that has not received his prior clearance BEFORE the federal entity makes any arrest, seize or destroy any private property and to accompany the federal agency or officers during the action. Any federal agent or officer who acts without prior clearance will have committed a state felony and be subject to arrest by the Sheriff. In Mack/Printz v USA, the Supreme Court declared that the states or their political subdivisions “are not subject to federal direction.” Justice Scalia writes, “The different governments will control each other, at the same time that each will be controlled by itself.”
People further need to understand that the Federal Government’s powers are limited to the enumerated powers listed in the US Constitution. (click here to view the list of enumerated powers) The Supremacy Clause only applies to those enumerated powers. At no time and under no circumstances will local or state departments or agencies ever turn their control over to the federal government.
